A BILL to amend article two, chapter twenty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section five-d,
relating to prohibiting certain fertility control in
wildlife.
Be it enacted by the Legislature of West Virginia:
That article two, chapter twenty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
five-d, to read as follows:
ARTICLE 2. WILDLIFE RESOURCES.
§20-2-5d. Use of chemicals, biological compounds or devices on
free roaming wildlife populations for fertility control.
Notwithstanding any other provisions of this code and except
as specifically authorized by the director in consultation with
the wildlife resources section of the division, it is unlawful
for anyone to administer any chemical, biological compound or
device to free roaming or noncaptive wildlife for the purpose of
fertility control. The director of natural resources shall issue
such authorization in accordance with rules promulgated pursuant
to chapter twenty-nine-a of this code.

NATURAL RESOURCES COMMITTEE AMENDMENTS
On page two, section five-d, line three, after the word
"control." by striking out the remainder of the paragraph and
inserting in lieu thereof the following:
The division of natural resources shall promulgate rules in
accordance with the provisions of chapter twenty-nine-a of this
code for issuance of such authorization by the director.
And,
On page one, by striking out the title and substituting
therefor a new title, to read as follows:
